Loubotin has won their court case for the red soles trademark. The highest court in the European Union decided that another company, Van Haren, sold similar shoes and infringed on the Loubotin trademark. The court said it didn’t matter if the shoes were shaped differently. It’s the fact that the color on the bottom part of the shoe would cause confusion in the marketplace.
