Federal Judge Rules Texans Can Vote by Mail

In a ruling handed down on Tuesday, a federal judge opened the door for absentee voting in Texas. U.S. District Judge Fred Biery sided with the Texas Democratic Party, making all of the state’s voters — regardless of age — eligible for mail-in voting during the coronavirus pandemic. His ruling overturns a Texas law that limits mail-in ballots to people 65 and older. “Two hundreds forty-years on, Americans now seek life without fear of pandemic, liberty to choose their leaders in an environment free of disease and the pursuit of happiness without undue restrictions,” Biery said when announcing his verdict. Although opponents of the move have argued that switching to a mail-in voting system would result in voter fraud, Biery said he found “little or no evidence” of that happening in states where voting by mail is permitted.
