As Chris Brown is being transported from Los Angeles to Washington, D.C., to stand trial in a misdemeanor assault case, there is a report that prosecutors in D.C. are considering upping the charge to a felony.
According to TMZ.com, prosecutors have filed documents saying they can justify upgrading the charge. The prosecution apparently believes that because the victim’s injuries were serious enough to require hospital care, it can gather the evidence necessary to change the charge to a felony.
The case stems from an incident outside a hotel last October when Brown and his bodyguard were arrested and charged with misdemeanor assault after allegedly attacking a man.
As previously reported Brown’s attorney, Mark Geragos, has calling for the case to be dismissed, claiming that prosecutors misused the the grand jury system. But according to TMZ prosecutors say they have taken the case to a grand jury because they believe they have evidence to support a felony charge. The trial is scheduled to begin April 17.
Meanwhile Brown, who is being transported from a Los Angeles jail to D.C. by U.S. Marshals, still faces a probation violation hearing in Los Angeles later this month. He was taken into custody in Los Angeles on March 14, after he was ejected from a facility where he was undergoing court-ordered treatment for anger management and other issues. That treatment was mandated as part of his probation in his 2009 assault on then-girlfriend Rihanna.
